UK Competition Appeal Tribunal Grants Collective Proceedings Order in Apple iCloud Competition Case

The UK Competition Appeal Tribunal has granted a Collective Proceedings Order in Consumers’ Association (Which?) v Apple Inc and Others (Case No. 1689/7/7/24), authorising Which? to pursue collective proceedings on behalf of millions of UK consumers concerning alleged abuses of dominance relating to Apple’s iCloud storage services.


The proceedings have been certified on both an opt out and an opt in basis. According to Which?, the claim could encompass approximately 40 million consumers and seeks damages estimated at around £3 billion, together with injunctive relief requiring Apple to cease the alleged anti-competitive conduct. Apple denies all allegations.


The Tribunal has authorised Which? to act as the class representative and has listed the trial for October 2028.


This certification represents another significant milestone in the development of the UK collective proceedings regime before the Competition Appeal Tribunal and illustrates the continuing expansion of competition collective actions in digital markets.
